The Chairman of the Local Trade Union of OzenMunaiGas Employees, Bekkali Uakbayev, addressed the Federation of Trade Unions of the Republic of Kazakhstan with a request for assistance in protecting the rights of residents of Zhanaozen and Zhetybai settlements of the Mangystau region.
In the appeal, residents point to the violation of their rights under voluntary pension annuity agreements concluded with insurance organizations “Halyk-Life”, “Nomad”, “EBRAZIA”, “Standard-Life”, “Freedom-finanse”, “Grandes”.
As noted, the concluded Pension annuity Agreements restrict the right of applicants to exercise their right to own, use and dispose of their property (pension savings).
According to the citizens, the pension annuity agreements were concluded by them as a result of delusion.
Now applicants cannot terminate these Contracts due to legislative restrictions established by the Law “On Pension Provision in the Republic of Kazakhstan”.
Thus, in accordance with paragraph 6 of Article 60 of the Law, termination of the pension annuity contract is possible only on the initiative of the policyholder, provided that the pension annuity contract is concluded with another insurance company, but not earlier than two years from the date of its conclusion.
It is this norm, from the position of the applicants, that infringes on their rights and does not allow them to terminate the pension annuity agreement.
Having studied this issue, the Federation of Trade Unions of the Republic of Kazakhstan, within its competence, initiated an appeal to the social partners represented by the Ministry of Labor and Social Protection of the Republic of Kazakhstan with a request to consider making legislative changes in terms of simplifying procedures for the termination of previously concluded pension annuity contracts, as well as taking other measures to protect the rights of citizens.
In addition, due to the need for a comprehensive study of the situation, it is proposed to consider the possibility of organizing a platform for discussing this issue with the participation of representatives of all interested parties.
Work in this direction continues and is under the control of the Federation of Trade Unions.
