FTURK EDUCATIONAL MARATHON: TO PROFESSIONAL DISPUTE RESOLUTION

Within the framework of the FTURK educational marathon, another seminar was held on the topic “Collective labor disputes. Conciliation procedures” for the professional asset of Almaty, Almaty and Zhetysu regions.

Opening the seminar, Lyazzat Eszhanova, project coordinator, Deputy Director of the Department of Organizational and Control Work of the FTURK, noted that the topic of today’s seminar is very relevant and is aimed at supporting trade unions in resolving conflicts and collective labor disputes.

The speaker of the seminar was Saruar Kenzhebulat, Chairman of the Committee on Socio-Economic Relations and Social Partnership of the Federation of Trade Unions of the Republic of Kazakhstan. Saruar Kenzhebulat is one of the authors of the Federation of Trade Unions Activity Strategy for 2020-2025 “In unity to justice and development.”

At the online meeting, the speaker focused on issues arising in connection with collective labor disputes of employees from a theoretical point of view and shared problems arising in practice.

The seminar participants also learned that the institute of mediation can be used in resolving collective labor disputes, involving intermediaries with their written permission, who are not affiliated with the parties to the labor dispute. “The grounds for holding strikes may be: If a collective labor dispute could not be resolved through conciliation procedures; if the employer evades conciliation procedures; if the conditions of previously reached agreements on a collective labor dispute are not fulfilled,” the lecturer listed.

During the seminar, a consistent algorithm for resolving collective labor disputes was obtained, based on the recommendations of international human rights standards in the field of social and labor relations and on the provisions of the national legislation of the Republic of Kazakhstan.

Trade union leaders and trade union activists of Zhambyl and Kyzylorda regions will take part in the next seminar within the framework of the FTURK  educational marathon.
