CANDIDATE FOR PRESIDENT OF THE FEDERATION OF TRADE UNIONS OF KAZAKHSTAN, AMANGELDY TASPIHOV ADDRESSED WITH INITIATIVES IN THE PUBLIC AND LEGISLATIVE BODIES

Candidate for President of Kazakhstan from the Federation of trade unions of Kazakhstan Amangeldi Taspikhov addressed to the Government on problematic issues of social protection and promotion of teachers.

According to the results of meetings with voters of the candidate for President of the Federation of trade unions of Kazakhstan, Amangeldy Taspihov expressed concern that teaching staff in some regions are not receiving the required law of the Republic of Kazakhstan benefits.

First of all, we are talking about the payment of compensation to cover the cost of utilities and the purchase of fuel for heating residential premises.

“The analysis showed that there are still regions in which teachers do not receive the benefits laid down by the legislation of the Republic of Kazakhstan, — stated in the appeal.

At the same time, the candidate Amangeldi Taspikhov paid special attention to the discrepancy between the amount of compensation costs for utilities and the purchase of fuel to real market prices and depend on the capabilities and desires of the akims of the districts.

In this regard, as A. Taspikhov stressed, the issue of increasing the amount of one-time monetary compensation, as well as the need to develop a single mechanism for providing utilities and fuel for teachers living in rural areas, taking into account the climatic conditions of the regions.

The appeal also touched upon the issue of medical examination of teachers, which in accordance with the legislation should be carried out at the expense of the employer. However, in some regions of the country teachers are forced to undergo an annual medical examination at their own expense.

No less urgent issue voiced in the appeal is the payment of environmental benefits to employees of educational institutions of the East Kazakhstan region.

“At present, not all educational institutions of the East Kazakhstan region pay environmental benefits and provide additional leave to persons who do not have an environmental certificate, despite the fact that the norm is spelled out in the Agreements and collective agreements,” Amangeldi Taspikhov said in his address.

Candidate for President of Kazakhstan from the Federation of trade unions of Kazakhstan Amangeldi Taspikhov addressed to the Majilis of the Parliament of the Republic of Kazakhstan on improvement of labour legislation.

The appeal noted the relevance of amendments to the Labor code of the country in terms of simplification of procedures for the nomination of workers ‘ claims and conciliation procedures (conciliation Commission, labor arbitration) and the consideration of collective labor disputes.

“Over the past six years, according to the Ministry of labor and social protection, 65 labor conflicts and strikes took place in the country, most of the requirements for which were met.

At the same time, almost all strikes were declared illegal by the courts, due to non-compliance of the workers with the procedure for making demands.

Thus, we have a legal incident, when the Law recognizes the actions of employees illegal, but their requirements in the end, for the most part, are satisfied by the employer.

Currently, the norms of the Labor code regarding the announcement of a collective labor dispute are so complex that employees can not move to the negotiation processes provided for by the same Labor code. And as a result, it forces workers to go on spontaneous strikes”, — stated in the address of the candidate for President of Kazakhstan Amangeldi Taspikhov.

Candidate for President of Kazakhstan from the Federation of trade unions Amangeldi Taspikhov made a proposal to the Majilis on the issue of binding collective agreements in all organizations and enterprises at the legislative level

According to the Ministry of labor and social protection of the Republic of Kazakhstan, only 42.6% of enterprises and organizations have collective agreements. At the same time, collective agreements have been concluded at 98 per cent of enterprises that have trade Union organizations.

Experts note that in enterprises where collective agreements are not concluded, workers are not protected in their rights, more often there are labor disputes and conflicts.

“The presence of a collective agreement at enterprises and its responsible execution is a guarantee of stability in the workforce and the main tool for protecting the labor rights of workers.

Today there is a legal gap in the legislative approach to collective bargaining. Thus, the Code of administrative offences (art. 97) contains provisions on the liability of the employer for evading participation in negotiations on the conclusion of a collective agreement, as well as for unjustified refusal to conclude a collective agreement. These rules, once there is responsibility, already determine the obligation of the employer to conclude a collective agreement,” the text of the appeal says.

Candidate for President of Kazakhstan from the Federation of trade unions of Kazakhstan Amangeldi Taspikhov sent an appeal to the Ministry of foreign Affairs on Kazakhstan’s ratification Of the International labour organization (ILO)

To date, Kazakhstan has ratified only 24 ILO conventions out of 189 existing ones, 8 of which are fundamental.

Among the existing ILO Conventions affecting the essential rights and interests of workers, Amangeldi Taspikhov noted the importance of accession to the five ILO conventions:

— Convention 102 on minimum standards of social security»;

— Convention 131 on the establishment of minimum wages with special regard to developing countries»;

— Convention 154 on the promotion of collective bargaining»;

— Convention 175 on part-time work»;
