The Federation of Trade Unions, on all issues related to the appeal of individuals and legal entities, is guided by the Law of the Republic of Kazakhstan dated January 12, 2007 No. 221-III “On the procedure for considering appeals of individuals and legal entities” hereinafter – (Law).
According to paragraph 4 of Article 1 of the Law, an appeal is an individual or collective written, oral or in the form of an electronic document, videoconference, video appeal, proposal, application, complaint, request or response sent to the subject considering the appeal, or to an official.
The appeal should be addressed to the subject or official, whose competence is to resolve the issues raised in the appeal. In the appeal of an individual, his last name, first name, and also, if desired, patronymic, individual identification number (if any), postal address, of a legal entity – its name, postal address, business identification number are indicated. The appeal must be signed by an individual or a representative of a legal entity.
When filing a complaint, the name of the subject or position, the names and initials of the officials whose actions are being appealed, the reasons for the appeal and the requirements are indicated.
ATTENTION: not subject to consideration:
• anonymous appeal, except for cases when such appeal contains information about impending or committed criminal offenses or about a threat to state or public security and which is subject to immediate redirection to state bodies in accordance with their competence;
• an appeal that does not set out the essence of the issue.
The appeal should be addressed to the subject or official, whose competence is to resolve the issues raised in the appeal. If the competence of the official does not include the resolution of the issues raised in the appeal, the applicant is sent a message about this no later than three working days from the date of its receipt.
In Art. 7 of the Law is established, any appeal submitted by you is subject to compulsory acceptance, registration, accounting and consideration.
