AN INTERNATIONAL ROUND TABLE ON THE TOPIC “MEDIATION IN THE FIELD OF LABOR” WAS HELD IN PAVLODAR

The international round table “Mediation in the sphere of labor” with the participation of judges, representatives of trade unions, mediators of Kazakhstan and the Russian Federation, scientific intelligentsia, practicing lawyers and lawyers, law students was held by the Territorial Association of Trade Unions of the Pavlodar region.

The head of the Department of Civil Law of the Kazan branch of the Federal State Budgetary Educational Institution of Higher Education “Russian State University of Justice” Candidate of Law, Associate Professor Zakirov Radik Yurievich addressed the participants of the round table with words of greeting.

Judges of the Pavlodar Regional Court Tergemesova G.B. and the Pavlodar City Court Shevchenko V.N. made reports on conciliation procedures when considering labor disputes in civil proceedings and topical issues of resolving labor disputes through conciliation procedures.

The Chairman of the NGO “Local Trade Union of Employees of the South-Eastern Structural Divisions of KazTransOil JSC, Doctor of Pedagogical Sciences, Professor of Non-profit JSC Toraigyrov University Pfeiffer N.E. shared her practical experience in protecting the labor rights of employees through social partnership tools, conducting conciliation procedures and the work of conciliation commissions.

“The most effective mechanisms for resolving labor disputes are the collective agreement, the prompt adoption of an additional agreement to the collective agreement, conciliation procedures, the use of a range of mediation techniques and a conciliation commission”,- the speaker noted.

The guest of the dialogue platform, a professional mediator, practicing lawyer, Candidate of Law, Associate Professor of the Department of Theoretical and Public Law Disciplines at the Institute of State and Law of Tyumen State University, Yulia Vladimirovna Kholodionova, shared her experience of reconciliation as a mediator of the Russian Federation in labor disputes.

Deputy Chairman of the NGO “Local Trade Union Batyr Komir” Mikhailyuk S.Yu. told about the work of the conciliation commission operating at Bogatyr Komir LLP.

“The higher the level of knowledge of the members of the conciliation commission, the faster the workers’ labor rights will be restored,” the speaker noted.

The practice of resolving labor disputes with the participation of a mediator in the Reconciliation Center “Tatulasu Ortalygy” of the Territorial Association of Trade Unions of the Pavlodar region was told by the head of M.A. Ivanova.

“Since the opening of the Reconciliation Center “Tatulas Ortalygy” of the Territorial Association of Trade Unions of the Pavlodar region, legal assistance has been provided to more than 3,000 applicants, more than 900 procedures have been conducted through mediation, of which 789 labor disputes involving the mediator of the Trade Union Center were resolved positively in favor of the employee,” the head of the Reconciliation Center shared information.

Following the results of the round table, the chairmen of trade unions and mediators spoke.

The chairman of the NGO “Pavlodar regional organization of the Kazakhstan Branch Professional Union of Education and Science Workers” G.A. Naurazbaeva, noted the content and relevance of the disclosure of the topic “Mediation in the field of labor” by the speakers of the round table. “Mediation has its historical roots in the Republic of Kazakhstan, because traditionally the reconciliation of the disputing parties was carried out by the biy courts, which sought to reconcile the conflicting parties,” G.A. Naurazbaeva stressed.

Professional mediator Nikolashina O.L. emphasized the high level of fruitful cooperation with the Territorial Association of Trade Unions of Pavlodar region on the development of mediation for the region in the labor and social sphere, the development of school and student mediation.

Concluding the round table, the chairman of the Territorial Association of Trade Unions of Pavlodar region” Aitzhanova D.N. stressed: “There are no losers in a labor dispute that is resolved through mediation, this is a civilized form of dialogue that must be actively used in resolving labor disputes.”
