BY JOINT ACTIONS OF SOCIAL PARTNERS, 12 PEOPLE WERE REINSTATED AT WORK

The trade union center of the Kyzylorda region managed to defend the rights of 12 employees of the KazPetrolGroup oil company, dismissed in September 2021, for the initiative to create a trade union organization.

The litigation between the employer and the members of the initiative group of employees was the focus of special attention of the Federation of Trade Unions..

On behalf of the Chairman of the FTURK, representatives of the Trade Union Center of the Kyzylorda region Marat Baimbetov and Mayra Boranbayeva, together with the regional labor inspectorate, took an active part in protecting workers throughout the trial.

In addition, at the initiative of the Trade Union Center, this issue was submitted to the regional tripartite commission on social partnership, and was also repeatedly discussed with the employer at the trade union site.

The day before, the court put an end to the case, recognizing the illegal actions of the employer to terminate the employment contract with employees.

The judge of the Kyzylorda City Court, M. Toguzbayeva, made a decision on the restoration of employees with payment for the time of forced suspension from work.

The court found that the grounds for termination of the employment contract, which the employer is guided by, is illegal, which violates the labor rights of citizens (paragraph 3 of Article 50 of the Labor Code of the Republic of Kazakhstan).

Azamat Kalzhanov, one of the reinstated workers, expressed gratitude to the trade unions on behalf of his colleagues for their participation in the protection of social and labor rights.

“The court fully satisfied the demands of 12 of our employees who were dismissed unfairly and unreasonably. Justice has been done. By decision, we were reinstated at our workplaces. Without the help of trade unions, we would not have achieved this. I am grateful to the representatives of the Trade Union Center, Marat Baimbetov and Maira Boranbayeva, who have been engaged in our business since September 2021, defending our rights in court, negotiating with the employer and government agencies. Thanks to their support, the rights of 12 employees and the interests of their families are protected”” Azamat Kalzhanov said.

It should be noted that the members of the initiative group are still planning to create a trade union organization in the near future. Further development of the situation in this labor collective will be under the control of the Federation of Trade Unions of the Republic of Kazakhstan.
