Republican Trade Union Association
“Federation of Trade Unions of the Republic of Kazakhstan”

 

I. General Provisions

1. The Republican Union of Trade Unions “Federation of Trade Unions of the Republic of Kazakhstan” (hereinafter Federation) is a non-profit organization created in a different organizational and legal form. It unites branch trade unions, territorial (at the oblast level, cities of republican significance, capital) unions of trade unions.
The Federation operates in accordance with the Constitution of the Republic of Kazakhstan, laws and other normative legal acts of the Republic of Kazakhstan, universally recognized principles and norms of international law, this Statutes.
2. The Federation is building its activities in accordance with the opinion and will of its affiliates on the following principles:
— voluntariness of joining the Federation and free exit from it;
— independence in activities, equality of its members, partnership, dialogue and cooperation;
— collegiality, electively, transparency in the work of the governing bodies of the Federation;
— respect for the opinion, the rights of each member organization to protect and explain its position;
— solidarity, support and mutual assistance of member organizations in the implementation of common tasks;
— recognition and implementation by the member organizations of the Federation Statutes.
The federation is independent in its activities from state authorities, employers and their associations, political parties and other public associations, they are unaccountable and uncontrollable.
3. The Federation cooperates with trade unions of other states, can join international trade union and other public associations in accordance with the legislation of the Republic of Kazakhstan.
The Federation cooperates with the Parliament of the Republic of Kazakhstan, the Government of the Republic of Kazakhstan, local representative and executive authorities of the Republic of Kazakhstan, employers’ associations, various political parties and movements, other public associations, non-governmental organizations.
The Federation is not responsible for the obligations of its affiliated organizations, nor do affiliated organizations are responsible for the obligations of the Federation.
The Federation has the right to create solidarity funds, charitable and other funds aimed at the social protection of trade union members.
The Federation has a stamp, stamps, bank accounts with its name, symbols and attributes.

— in the russian language – The Republican Association of Trade Unions “Federation of Trade Unions of the Republic of Kazakhstan”.

II. Subject and objectives of the Federation

4. The Federation was established to consolidate and coordinate the activities of member organizations for the representation and protection of socioeconomic, labor rights and interests of trade union members, and to assist in ensuring legal guarantees for the activities of trade unions.
To achieve its goals, the Federation carries out the following tasks:
— develops and defines the main activities and strategy of the Federation;
— consolidates and coordinates the activities of affiliated organizations affiliated to the Federation;
— represents interests of affiliated organizations in representative and executive bodies of power, in courts;
—promotes development of the system of social partnership at all levels;
— acts as a party to social partnership in concluding a General Agreement with the Republican employers’ associations and the Government of the Republic of Kazakhstan, participates in negotiations on drafting an agreement and its conclusion and carries out public control over their implementation;
— participates in the development or makes proposals to the relevant state authorities on the consideration of draft laws and other regulatory legal acts on the organization, payment and standardization of labor, budgetary and tax policies, employment, social policy, privatization, labor protection, occupational diseases, environmental safety and other issues relating to social and labor relations; carries out public control over observance of labor legislation;
— takes part in the development and formation of state programs for employment, labor and environmental protection; social programs aimed at creating conditions that ensure a decent life and free development of a person;
— organizes a public trade-union examination of draft laws, other regulatory legal acts, state programs;
— takes part in the election of deputies of the Parliament of the Republic of Kazakhstan and local representative bodies in accordance with the legislation;
— favors and promotes the social orientation of state economic and price policies in matters of labor, employment and other socio-economic issues relating to the level and quality of life of workers;
— in accordance with the legislation of the Republic of Kazakhstan, in conjunction with state authorities and employers, promotes the organization and holding of recreational activities among members of trade unions and their families, implements measures for the development of sanatorium and resort treatment, the improvement of children and adolescents, tourism, recreation, culture, mass physical education and sports;
— cooperates and assists affiliates in establishing contacts with foreign, international trade union associations and other international organizations working in the field of protecting the rights and freedoms of workers;
— seeks ratification by the Republic of Kazakhstan of international treaties, conventions on labor relations, civil rights, socio-economic and other issues, legislative consolidation and implementation of universally recognized principles and norms of international law;
— participates in the settlement of collective labor disputes, uses other means of protecting labor, social and economic rights and interests of workers, coordinates collective actions of member organizations;
— carries out legal assistance to affiliated organizations, promotes the activities of trade union labor inspections, legal services and consultations, and carries out explanatory work;
— organizes training, retraining, professional development of trade union personnel and the asset, promotes the legal and vocational training of members of trade unions, including mediation;
— carries out information and propaganda, cultural, educational and publishing activities;
— studies and disseminates the experience of trade unions;
—assists in securing the rights and guarantees of trade unions, their associations, elected trade unionists;
— ensures the integrity and unity of trade unions;
— assists in building and strengthening the ties of territorial unions of trade unions with local executive and representative bodies;
— contributes to the construction of the structure of trade-union movement, corresponding to the structure of the economy and integrating into the processes of globalization, as well as the optimal, in terms of organizational and financial resources;
— promotes attestation of production facilities by working conditions;
— assists in the implementation of a single personnel and financial policy in the trade unions of the Federation.

III. Membership organizations of the Federation, their rights and duties

5. Member organizations of the Federation may be legal entities that recognize and implement this Statutes:
— branch trade unions that protect the social and labor rights and interests of trade union members on the basis of the current legislation, sectoral agreements and collective agreements, purposefully carrying out work on organizational, financial, personnel strengthening of trade unions;
— territorial unions of trade unions (at the region level, cities of the republican significance, the capital) that work to coordinate the activities of the structural organizations of the republican and regional industrial trade unions that are affiliated to the Federation and contribute to ensuring their activities in the regions of the republic in order to protect socioeconomic, labor rights and interests of trade union members on the basis of regional agreements
The statutes of branch trade unions, branch and territorial unions of trade unions should correspond to the purposes and tasks defined by the Statute of the Federation.
6. The Federation affiliates retain their independence and the rights of the legal entity, act in accordance with the legislation of the Republic of Kazakhstan and its own statutes.
Structural organizations of trade unions that are affiliated organizations of the Federation should interact with territorial (at the level of the region, the city of the republican significance, the capital) unions of trade unions.
7. Admission to the Federation of new member organizations is carried out on the basis of a decision and a written request of the collegial body of the legal entity.
An organization that joins the Federation and an organization that changes its status represents:
— decision of an elected authority and a written application for joining the Federation;
— constituent documents (the charter of the trade union, the territorial association of trade unions, a copy of the certificate of registration, etc.);
— statistical data on the number of trade unions and the territorial association of trade unions;
— information on the location of their elected bodies;
— obligation to fulfill the Statute of the Federation, payment of contributions.
8. Membership in the Federation may be terminated:
— by decision of the authorized body of the member organization on its withdrawal from the Federation;
— in case of liquidation, reorganization of a member organization;
— in connection with the expulsion of a member organization from the Federation of Trade Unions.
A member organization is deemed to have withdrawn from the Federation one month after the application has been submitted to the General Council. Prior to the expiry of this period, the membership organization continues to exercise its rights and obligations in accordance with this Statute.
A member organization that has decided to terminate its activities (liquidation) is deemed to have lost its membership in the Federation from the moment it notifies the Federation Executive Committee.
The question of the participation in the activities of the Federation of member organizations that do not comply with the statutory requirements, systematically deviating from the implementation of decisions of its supreme and governing bodies acting at the expense of the interests and goals of the Federation and its affiliated organizations, and also not transferring without honorable reasons membership fees in the established size, is decided by the General Council of the Federation.
The head of the membership organization and other members of the General Council delegated from this affiliated organization for violation of the membership of the Federation Charter and non-payment of membership fees to the Federation in accordance with the established procedure within six months may be deprived of voting rights in the General Council, the Executive Board for up to six months or withdrawn from the General Council, the Executive Committee. In the event that the member organization has not eliminated these shortcomings and has not repaid the debt within the prescribed period, the question of its participation in the activities of the Federation is decided by the General Council.
If the member organization eliminates violations, the Executive Committee shall consider the issue of restoring their membership in the General Council, the Executive Committee, and the affiliated organization within the Federation with subsequent approval by the General Council.
When a member organization eliminates violations, the Executive Committee shall decide on restoring the voting right of the head and other representatives of this member organization.
The decision to exclude a member organization from the Federation, as well as from the founders, if it is such for these reasons is adopted by the General Council and is considered adopted if at least two-thirds of the General Council members present at the meeting voted for it, in the presence of a quorum.
Membership organizations that have terminated their membership in the Federation do not have the right to the property of the Federation, as well as to paid membership fees and property transferred to them by the Federation.
9. Membership organizations of the Federation have the right of:
— represent their organizations and trade union members in the Federation bodies, delegate, elect their representatives to these bodies, recall and replace them;
— participate in the development of the proposals of the Federation to draft laws and other regulatory legal acts affecting the social and labor rights of employees;
— make proposals and participate in the activities of the Federation to develop and conclude a General Agreement;
— apply to the Federation bodies on the statutory issues of trade union activities and receive relevant information, advice and assistance, legal protection of their rights and interests in state bodies;
— to receive assistance from the Federation bodies in the implementation of contacts with foreign and international associations of trade unions, the International Labor Organization;
— take part in the development of various programs and the creation of the Federation funds;
— to submit draft documents for consideration of congresses, conferences and elective bodies of the Federation;
— use the Federation’s capabilities to train trade union personnel and the asset, receive and disseminate information;
— use the Federation symbols in accordance with the approved Regulations.
10. The member organizations of the Federation are obliged to:
— comply with the Federation Charter, intra-union discipline, implement the decisions of the Federation bodies and be responsible for their implementation;
— support the activities of the Federation and take an active part in the implementation of its goals and objectives, show solidarity in protecting the rights and interests of Federation affiliates;
— to pay membership fees to the Federation in accordance with the established procedure, terms and sizes;
— mutually recognize trade union membership;
— refrain from any measures that may damage the activities of the Federation, other affiliated organizations and lead to the isolation of trade union organizations from the Federation of Trade Unions, branch trade unions, as well as territorial associations of trade unions;
— do not allow the transition of primary trade union organizations, local trade unions from one trade union to another without prior mutual agreement;
— inform the Federation of the changes and additions made in their charters and in the management staff within seven working days from the date of the change;
— to provide statistical information on the number of members of trade unions, financial statements related to the calculation and payment of membership and other contributions to the Federation, other information in the volume and order established by the authorities of the Federation;
— inform the Federation of the participation in the elections of the deputies of the Parliament of the Republic of Kazakhstan and local representative bodies of the Republic of Kazakhstan, the conclusion of treaties and agreements with political parties and movements, accession to and exit from international trade union associations;
— conduct a unified personnel policy, consultations with the Federation on the selection, placement and training of trade union personnel, the formation of their reserve;
— to consider on the collegial bodies the issues proposed by the bodies of the Federation;
— to promote the conclusion and implementation of the General Agreement;
— to show solidarity and take part in the organization and holding by the Federation of collective actions of trade unions;
Do not allow actions that infringe on the interests of the Federation and its affiliated organizations;
— to provide financial and other support to the mass media established by the Federation.
— inform the Federation of own activities.
In case of non-fulfillment of these duties, the Federation Executive Committee has the right to introduce a corresponding representation to the membership organization. The elected body of the member organization is obliged to consider the submission and in a month’s time to notify the Federation Executive Committee.

IV. Interaction of branch trade unions and territorial unions of trade unions

11. Sectoral trade unions and territorial (at the oblast level, cities of republican significance, the capital) unions of trade unions closely interact in their practical activities; within the framework of this Statute:
— carry out joint work on the selection and training of trade union personnel, the formation of their reserve; agree among themselves candidates for election as delegates to congresses, conferences of the Federation of Trade Unions for leadership positions of trade union organizations;
— assist the primary trade-union organizations, local trade unions that are members of the Federation, in collective bargaining, in the conclusion of collective agreements and agreements; resolving emerging labor conflicts;
— jointly provide trade-union organizations with practical, organizational, methodological, legal assistance;
— take measures to create in the corresponding territory of unified legal advice, trade union inspections, contribute to the formation of solidarity funds and assistance to the unemployed;
— promote the creation of territorial professional associations in the cities and districts of representatives of branches and representative offices of trade unions with a view to a joint and coordinated solution of regional problems, the establishment of social partnership with local executive bodies, employers, the pooling of efforts for social protection and mutual support of trade unionists and trade union members.
— carry out measures aimed at creating primary trade union organizations, strengthening trade union influence and implementing social and economic development programs for the industry and the region, implementing decisions of the Federation bodies, other general federal measures;
— conduct joint actions in defense of the rights and interests of trade unions and trade union members.

V. Authorities of the Federation

12. The highest body of the Federation is the Congress, which is convened by the General Council of the Federation at least once every five years. The convocation and proposed agenda of the Congress is announced no later than two months before the Congress. The norm of representation of delegates to the Congress is established by the General Council of the Federation of Trade Unions.
The governing authority of the Federation is the General Council of the Federation.
The collegial executive body is the Federation Executive Committee.
The executive and administrative functions are exercised by the President of the Federation.
The Control and Revision Authority of the Federation is the Revision Commission of the Federation of Trade Unions of the Republic of Kazakhstan.
13. Congress of the Federation:
— hears reports on the activities of the General Council of the Federation and the Audit Commission of the Federation;
— approves the Statute of the Federation, regulations on the Audit Commission, amendments and additions to them. The Congress has the right to delegate this right to the General Council on a specially issued authority;
— determines the next tasks and strategy of the Federation;
— elects the chairman of the Federation, the Audit Commission of the Federation;
— approves the composition of the Federation Council General Council;
— takes decisions, resolutions, statements, addresses on the most important issues of the life of the country, the activities of state bodies, trade union movement;
— considers appeals on the application of this Statute;
— takes decisions on reorganization, termination of activities and liquidation of the Federation.
14. The Congress is considered eligible if it is represented by at least two thirds of the membership organizations and there are at least two-thirds of the delegates elected from them.
Decisions of the Congress shall be deemed adopted if more than half of the votes of the delegates participating in voting in the presence of a quorum are submitted for them. The procedure for voting in the adoption of decisions of the Congress is determined by its delegates.
15. Extraordinary congresses of the Federation are convened by the General Council of the Federation or at the request of collegial bodies by at least one – third of its member organizations.
The decision on convocation of the Extraordinary Congress and the proposed agenda is announced not later than one month.
16. The General Council of the Federation is approved at the congress of the Federation on the principle of direct delegation. The General Council includes the heads of all Federation affiliates, as well as one representative of branch trade unions with more than 30,000 trade union members.
The General Council also includes the Chairman of the Commission for the Work of Women of the Federation of Trade Unions and the Chairman of the Youth Council of the Federation of Trade Unions.
17. The General Council of the Federation:
— ensures the implementation of the goals and objectives of the Federation, defined by this Statute;
— develops the basic directions of activity on implementation of decisions of congresses and statutory tasks, protection of labor, social and economic rights and interests of members of trade unions and affiliated organizations;
— reports on its activities before the Congress;
— hears and approves reports of the Office of Property and Assets of the Federation of Trade Unions;
— determines the procedure for transferring contributions by the Federation’s member organizations, adopts recommendatory documents concerning the system of remuneration of elected trade union employees;
— determines the procedure for owning, using and disposing of the property of the Federation of Trade Unions;
— determines the indicators of financial reporting related to the calculation and payment of membership fees and other money to the Federation, a list of statistical data submitted by member organizations;
— on the proposal of the Chairman of the Federation elects the Executive Committee of the Federation of Trade Unions;
— hears reports of the leaders of the Federation and information of member organizations on the implementation of the Charter and decisions of the bodies of the Federation, as well as their activities;
— determines the procedure for nominating candidates for the post of chairman of the Federation of Trade Unions;
— in the period between congresses, elects and dismisses the chairman of the Federation;
— makes proposals on amendments and additions to the Statute of the Federation and regulations on the Audit Commission for approval at the Congress;
— approves the Model Statutes of branch trade unions and territorial (at the level of the region, the city of the republican significance, the capital) unions of trade unions;
— decides on the conduct of the election campaign in the Federation;
— approves the descriptions and sketches of the Federation symbols and the Statute of symbols;
— carries out other functions delegated to him by affiliates and the Federation Congress.
18. The General Council of the Federation is convened as necessary, but not less than once a year and is considered eligible if at least two-thirds of the members of the General Council who have the right to vote participate in it.
Decisions of the General Council are taken by a majority of votes of its members participating in the meeting, unless otherwise provided by the Statute.
19. The General Council of the Federation of Trade Unions, in order to direct the work between its sessions, elects the Executive Committee (hereinafter the Executive Committee) from among the leaders of the Federation’s affiliated organizations.
The Executive Committee consists of deputy chairmen of the Federation, whose number should not be more than one-third of the total number of members of the Executive Committee.
A member of the Executive Committee may be the head of the membership organization, which pays timely and in full the membership fees for the activities of the Federation, fulfills the decisions of the authorities of the Federation.
The Executive Committee is accountable to the General Council of the Federation.
20. The Executive Committee:
— ensures compliance with the norms and requirements of the Federation Charter, decisions of the Congress and the General Council;
— considers the issues of admission of new members to the Federation, the exclusion and withdrawal of affiliates from it, and their withdrawal from the General Council (the Executive Committee), as well as the cancellation of these decisions, followed by the approval of decisions by the General Council;
— decides on the temporary deprivation and restoration of the voting right of the head and representatives of the member organization at the meetings of the elected bodies of the Federation
— conducts all-republican activities of trade unions;
— defines the main provisions of the General Agreement with the Government of the Republic of Kazakhstan and the republican associations of employers;
—approves the composition of plenipotentiary representatives of the Federation in government, departmental commissions and working groups;
— convokes meetings of the General Council of the Federation, determines the draft agenda and the place of its holding;
— organizes and coordinates the training of trade union personnel and assets;
— with the suggestion of the chairman of the Federation approves the structure, the staff list of the Federation’s apparatus, considers candidacies of heads of structural divisions and organizations established by the Federation;
— asks in due course for awarding state and other awards to trade union workers and activists, awards trade union organizations and members of trade unions with Certificates of Honor, diplomas and other marks of distinction Federation of Trade Unions;
— organizes the work of the Federation’s printed body, on the proposal of the chairman of the Federation appoints the chief editor of the printed authority;
— approves the budget for the maintenance of the apparatus of the Federation and the apparatuses of territorial (at the region, city of the republican significance, the capital) unions of trade unions, the conduct of intra-union and international activities;
— develops international relations with trade union organizations of other countries, studies the practice of their activities; Decides on the membership of the Federation in international trade union associations;
—interacts with deputy groups, factions of the Parliament of the Republic of Kazakhstan, determines joint action plans with them;
— develops proposals for concluding a General Agreement with the Government of the Republic of Kazakhstan and republican associations of employers, other agreements; seeks to ensure that their content meets the interests of the Federation’s member organizations, exercises public control over their implementation;
— creates commissions and other permanent or temporary working bodies, empowers them with powers, establishes the order of their functioning;
— hears reports of the leaders of the Federation and information of member organizations on the implementation of the Statute and decisions of the bodies of the Federation;
— submits to the elected body of the member organization the proposal to revoke decisions, suspend actions of member organizations, their bodies that contradict the resolutions of the General Council and the Executive Committee of the Federation of Trade Unions;
— unites and coordinates the activities of member organizations in the solution of federal tasks, conducts all-republican activities of trade unions;
— represents and defends the interests of affiliated organizations in the state authorities of the Republic of Kazakhstan, republican associations of employers;
— develops proposals and seeks to consolidate in the legislative and other normative legal acts issues relating to fiscal and tax policy, regulation of labor relations, employment, wages, conditions and labor protection, the environment, housing and cultural services, social security of employees;
— participates in the development and formation of state social and economic programs and promotes their implementation;
— in accordance with the current legislation, facilitates the holding of mass actions of trade unions including meetings, rallies, street processions, demonstrations, picketing and other collective actions, strikes;
— elects and dismisses deputy chairmen of the Federation and heads of territorial trade union associations on the proposal of the chairman of the Federation;
— regularly informs affiliates and trade union members about their activities;
— creates commissions and other permanent or temporary working bodies, empowers them with powers, establishes the order of their functioning;
— facilitates the resolution of disputes between Federation affiliates;
— decides on the opening of branches and representative offices of the Federation;
— executes the procedure for owning, using and disposing of the property of the Federation;
— decides on the conduct of the election campaign in the Federation;
— performs other functions delegated to him by the General Council of the Federation.
21. Meetings of the Executive Committee are convened as necessary, but at least once every three months.
The Executive Committee is authorized to adopt resolutions if at least two-thirds of the members of the Executive Committee participate in its meetings.
Decisions of the Executive Committee shall be taken by a majority of votes of its members participating in the meeting, unless otherwise provided by the Statute.
If necessary, the decisions of the Executive Committee may be taken by poll. The opinion of the interviewed members of the Board is stated in writing.
22. Chairman of the Federation:
— ensures the implementation of the Statute, decisions of the Congress, the General Council, the Executive Committee;
— is accountable to the Congress and in the period between the Congresses – to the General Council;
— headed by the General Council of the Federation, the Executive Committee;
— represents the Federation of Trade Unions of the Republic of Kazakhstan in state authorities, employers’ associations, public associations, other organizations, the media, as well as in international organizations;
— makes in the necessary cases applications, sends appeals and petitions on behalf of the Federation of Trade Unions of the Republic of Kazakhstan;
— in agreement with the members of the Executive Committee, concludes agreements with unions of trade unions, employers, executive bodies, international and other organizations;
— disposes of the property and money of the Federation within the powers determined by the General Council, the Executive Committee;
— makes proposals to the Executive Committee on election and dismissal of deputy chairmen of the Federation and heads of territorial associations of trade unions;
— may propose candidates for elected positions of heads of Federation affiliates;
— if necessary, submits to the elected bodies of trade unions the idea of ​​bringing to justice officials for violation of the Statute;
— approves the distribution of powers and responsibilities between the chairman and deputy chairmen of the Federation;
— exercises general management of the Federation apparatus, appoints heads of structural divisions, determines their functions, accepts and dismisses employees, measures their moral and material incentives;
— issues orders; issues powers of attorney on behalf of the Federation and determines the procedure for issuing them by the deputy chairmen of the Federation;
— regularly informs affiliates and trade union members about their activities;
— performs other functions delegated to it by the General Council and the Executive Committee.
The Chairman of the Federation by position is a delegate of the Congress of the Federation, a member of the General Council and the Executive Committee and conducts their meetings. In the absence of the Chairman of the Federation, the session on his behalf is conducted by the Deputy Chairman of the Federation.
23. In the period between congresses the decision to dismiss the chairman of the Federation on his own initiative, as well as for actions contrary to the Charter is taken by the General Council. The decision to dismiss the chairman of the Federation and elect a new chairman of the Federation shall be deemed adopted if at least two-thirds of the members of the General Council.
24. Deputy chairmen of the Federation are delegates to the Congress of the Federation, they are members of the General Council and the Executive Committee.
In the absence of the chairman of the Federation, his authority, on behalf of the chairman of the Federation is exercised by one of the deputy chairmen of the Federation.
25. The Audit Commission of the Federation is a control and audit body that monitors the financial and economic activities of the Federation and the organizations it establishes; the calculation and receipt of membership fees and other money, the correctness of spending money, the use of property of the Federation of Trade Unions.
The Audit Commission is elected at the Congress from representatives of the Federation’s affiliated organizations, guided in its activity by the Regulation on the Audit Commission approved by the Congress.
The Chairman of the Audit Commission is elected at a meeting of the Audit Commission by a majority vote, he is a delegate to the Congress of the Federation of Trade Unions, he can participate in the work of the General Council and the Executive Committee with the right of deliberative vote.

VI. Property and financial activities of the Federation

26. The Federation is the owner:
— property obtained in the order of succession from the Kazakh Republican Council of Trade Unions (Kazsovprof) in accordance with the Resolution of the Executive Committee of the General Confederation of Trade Unions No. 2-14b of September 22, 1992 “On securing the rights to own, use and dispose of trade-union property for the Council of the Federation of Trade Unions of the Republic Kazakhstan”;
— income received from business activities;
— property formed from sources not prohibited by law.
The Federation is liable for its obligations with all property belonging to it.
The sources of formation of the property of the Federation are:
— The property of the Federation, formed in monetary and other forms in accordance with legislative acts;
— income from affiliates, including membership trade union fees;
— voluntary property contributions and donations;
— income from the sale of goods, works, services in cases prescribed by law;
— dividends (income, fees) received on shares, shares, bonds, other securities and deposits;
— Other, not prohibited by law, income.
The procedure for the receipt of financial and other funds from member organizations is determined by the constituent documents of the Federation.
Revenues received from any type of activity goes to statutory purposes.
27. The property of the Federation includes immovable, movable property created and acquired by the Federation or transferred to it in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
28. The property of the Federation of Trade Unions belongs to it on the basis of private property rights.
The Federation has the right in its discretion to perform any actions that do not contradict the law with respect to its property, transfer property for use, pledge, dispose of it in any other way.
The Federation has the right to carry out entrepreneurial activity in accordance with the current legislation in the Republic of Kazakhstan.
The Federation annually publishes in its press the results of the activities of the property of the Federation.
The procedure for the possession, use and disposal of property is determined by the General Council of the Federation.
29. Membership organizations of the Federation have the right to use the property of the Federation and participate in its management.
Legal regulation of property issues, use of property is established by the General Council of the Federation on the basis of the current legislation of the Republic of Kazakhstan and the decisions of the Congress of the Federation of Trade Unions.
30.The Federation establishes a unified procedure for the allocation of membership trade union contributions.
The money of the Federation is spent on the basis of approved estimates and is sent for the implementation of the statutory activities, holding republican, regional trade union and other events, organizing public expert evaluation of draft laws and other normative legal acts, providing legal, advisory assistance, organizing information, methodological work, , pension funds for trade union workers, training of trade union personnel and assets, publication of the republican general trade union newspapers and other statutory activities.
Territorial (at the level of the region, cities of republican significance, the capital) associations of trade unions are financed by the Federation.
The amount of deductions of membership fees by trade unions for the Federation is 1 percent and for the activities of territorial associations 1 percent of their gross receipts.
31. The federation has an independent balance sheet, bank accounts, including foreign exchange.

VІI. The procedure for introducing alterations and additions to the Statute of the Federation

32. Alterations and additions to the Statute are made at the congress of the Federation. In the period between congresses, partial changes and additions can be made by the General Council of the Federation in accordance with the special powers conferred by the Congress.

VІIІ. The procedure for the termination of the activities of the Federation and the use of the remaining property

33. The activities of the Federation can be terminated by the decision of the Federation Congress in the legislative order.
34. The decision on the liquidation or reorganization of the Federation of Trade Unions of the Republic of Kazakhstan is taken by the Congress. The decision is considered adopted if at least two-thirds of the delegates who voted for it with a quorum.
In the period between congresses the General Council of the Federation of Trade Unions is authorized to take a decision on the reorganization of the Federation with its subsequent approval at the Congress.
In the event of a decision to liquidate the Federation, the Congress or the General Council of the Federation shall appoint a liquidation commission.
The property of the Federation left after all settlements, repayment of loans, loans and interest on them and other mandatory payments are directed to the goals determined by the decision of the Congress.

ІX. Final provisions

35. The Federation has the rights of a legal entity. These rights are exercised by the Congress, the General Council, the Executive Committee, the Chairman of the Federation acting within the limits established by the legislation this Statute, resolutions of the congresses, the General Council and the Executive Committee.
