THE PARTICIPANTS OF THE SCHOOL OF THE TRADE UNION LEADER CONSIDERED THE LEGAL BASIS OF THE ACTIVITY OF TRADE UNIONS

Within the framework of the educational project of the FPRC “School of a Trade union Leader”, a seminar was held on the topic: “Legal foundations and guarantees of trade union activity in accordance with the Law on Trade Unions in the Republic of Kazakhstan”. This topic was presented to the audience by Deputy Chairman of the Federation of Trade Unions of the Republic of Kazakhstan Gulnara Zhumageldieva.

Speaking about the national legislation regulating the activities of trade unions, she elaborated on the norms of the Law of the Republic of Kazakhstan “On Trade Unions”, which enshrines the basic principles of their activities and legal guarantees.

During her speech Gulnara Zhumageldiyeva explained the structure, functions, tasks, rights and obligations of trade unions, the specifics of their creation, liquidation, payment of union membership fees, as well as issues of trade unions’ participation in social partnership, etc.

Taking into account the special importance of the protective function of trade unions, the speaker focused on the main aspects of the protection of labor, socio-economic rights and interests of trade union members.

“In accordance with Article 18 of the Law of the Republic of Kazakhstan “On Trade Unions”, trade unions are independent of the employer and through trade union bodies represent their members in relations with the employer, protect their labor and social rights and interests by: providing legal and advisory assistance, including when a trade union member enters into an employment contract with the employer; motivated opinions on the validity of termination of the employment contract, coordination of the working conditions of its members in accordance with the collective agreement, the Labor Code; applying to the court to protect the rights and interests of its members protected by the laws of the Republic of Kazakhstan; concluding a collective agreement, an agreement with an employer on behalf of its members, as well as on behalf of employees who are not members of a trade union, who authorized the trade union with a written statement; participation in the composition of the conciliation commission for individual labor disputes, the conciliation commission and labor arbitration when considering collective labor disputes,” Gulnara Zhumageldieva clarified.

An important task in the activities of the FPRC, according to her, is the implementation of public control over the observance of the rights of trade union members.

“Trade unions participate in the certification of production facilities for working conditions on an ongoing basis. The authorized representative of the trade union is a member of the commission for the investigation of industrial accidents. In order to carry out internal control over safety and labor protection, trade unions are part of the committee (commission) on safety and labor protection on a parity basis,” Gulnara Zhumageldieva added.

The participants were also interested in the activities of the FPRK Legal Clinic, which not only provides legal advice, but also assists in resolving problematic social and labor issues of trade union members.

At the seminar, opinions were exchanged on various situations from the practice of the professional asset. The participants received answers to all their questions with explanations of certain provisions of the legislation.

The author and coordinator of the project “School of the Trade Union Leader” – Deputy Director of the Department of Organizational and Control Work of the FPRK Lyazzat Eszhanova in conclusion noted that seminars for professional activists are an important measure to improve the efficiency of trade union work.

“The course program of the Trade Union Leader School covers a wide range of relevant areas of the trade union agenda and is aimed at improving the legal culture and professional skills of the professional asset,” Lyazzat Eszhanova emphasized.

Recall that the third set of the project “School of a Trade union leader” started on April 12 this year. The training course is designed for 36 academic hours. At the end of the training course, students will receive certificates of graduation from the Trade Union Leader School.
